In news that has caused gamers the world over to hide their faces in embarrassment, an irritated gamer who suffered “the red ring of death” failure on his Xbox 360 system is suing Microsoft and Nintendo for a recent system update that blocked his access to unauthorised third party sites.
The plaintiff is the same gamer who tried to sue Sony in September after being banned from the PlayStation network; that lawsuit was thrown out, a decision he is also apparently appealing. The lawsuit against Microsoft and Nintendo is, hilariously, citing the Declaration of Independence as its basis for the suit. “In federal terms, the plaintiff who relies heavily on video games for happiness, would like the federal court to decide if Nintendo is interfering with certain player’s pursuit of happiness, which is stated in the United States Declaration, where Benjamin Franklin was in agreement with Thomas Jefferson in downplaying the protection of ‘property’ as a goal of government, replacing the idea with ‘happiness’,” the suit reads, also alleging that “the stress put on the plaintiff having to find a new way to acquire a new Xbox 360 system and the sadness he will have in the meantime of finding one to afford.” You couldn’t make this stuff up.
Predictably, other gamers have reacted with despair to this turn of events, one noting “This is why gamers get a bad name” and another responding with a painfully succinct “This kid obviously has no social life.”
